Welcome to the Brown Healthcare Web Site (“Site”). Please review the following basic terms that govern your use of and purchase of products from our Site. Please note that your use of our Site constitutes your agreement to follow and be bound by those terms (the “Agreement”).

We may from time to time change the terms that govern your use of our Site. Your use of our Site following any such change constitutes your agreement to follow and be bound by the terms as changed.
We may change, move or delete portions of, or may add to, our Site from time to time. HipSaver Canada, DermaSaver Canada, HeadSaver Canada and Brown Healthcare are divisions of 2112218 Ontario Inc and the names may be used interchangeably and the conditions that apply to one division apply to all divisions.

HIPSAVER, HIPSAVER CANADA, DERMASAVER CANADA, HEADSAVER CANADA, BROWN HEALTHCARE and all other trademarks appearing at this Site are trademarks of 2112218 Ontario Inc and/or The HipSaver Company Inc. Users may reach brownhealthcare.com via hipsaver.ca / dermasaver.ca / headsaver.ca which all feed into 2112218 Ontario Inc’s main site, brownhealthcare.com.
The Contents of our Site, and the Site as a whole, are intended solely for personal, non-commercial (other than for the purchase of merchandise from our site) use by the users of our Site. You may download or copy the Contents and other downloadable materials displayed on the Site for your personal use only. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. You agree that no Comments submitted by you to the Site will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s). You further agree that no Comments submitted by you to the Site will be or contain libellous or otherwise unlawful, abusive or obscene material. You agree that Brown Healthcare may use and/or disclose information about your demographics and use of the Site in any manner that does not reveal your identity. By participating in Site sweepstakes, contests, promotions, and/or requesting promotional information or product updates, you agree that HipSaver Canada may use your information for marketing and promotional purposes.

You agree that Brown Healthcare may send electronic mail to you for the purpose of advising you of changes or additions to this Site, about any of its products or services, or for such other purpose(s) as deemed appropriate.
Product Information
While HipSaver has achieved excellent and impressive results, no product can claim to be 100% effective all of the time. Therefore HipSaver, Inc. and 2112218 Ontario Inc. makes no implied or express guarantee that its product will prevent injury.
While HeadSaver can achieve excellent and impressive results, no product can claim to be 100% effective all of the time. HeadSaver is not guaranteed to work in every individual instance. HeadSaver is not suitable to be used as a head protector either in an industrial or construction environment nor for sporting activities. The HeadSaver is not designed to protect the head from falling objects. Therefore, HealthSaver Pty Ltd and HeadSaver and 2112218 Ontario Inc and HeadSaver Canada make no implied or express guarantee that their products will prevent injury.
HipSaver and DermaSaver products are available exclusively in Canada through HipSaver Canada / DermaSaver Canada which are divisions of 2112218 Ontario Inc.. We do not sell HipSaver products outside of Canada however we will be pleased to refer international customers to their local dealer. The prices displayed at the Site are quoted in Canadian Dollars and are valid and effective only in Canada.
Colours
We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate.
Links to Other Websites and Services
To the extent that this Site contains links to outside services and resources, the availability and content of which Brown Healthcare does not control, any concerns regarding any such service or resource, or any link thereto, should be directed to the particular outside service or resource.

Indemnification
You agree to defend, indemnify and hold 2112218 Ontario Inc and all of its divisions harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Site.
Termination
This Agreement is effective unless and until terminated by either you or 2112218 Ontario Inc. You may terminate this Agreement at any time. 2112218 Ontario Inc also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, if in 2112218 Ontario Inc’s sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or 2112218 Ontario Inc, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise.
Payment and Billing
Methods of payment
Brown Healthcare accepts the following credit cards:

If we are unable to process your credit card, please check to ensure you entered the correct card number and expiration date, and that the billing name and address you entered match your credit card statement exactly. Please refer to your credit card company if the problem persists.
Facilities may choose to place orders using a facility purchase order number or trust account. In such cases, the ‘sold to’ will be the facility. Our payment terms when purchase orders are used are Net 30 days with 24% per annum interest charged on invoices outstanding over 30 days.

Overdue Accounts
We reserve the right to hold shipments for customers with outstanding invoices or to add a service charge to subsequent orders. Delinquent accounts will be referred to Dixon Commercial Investigators (1982) Inc. for collection.
Governing Law and Jurisdiction
The Web Site (excluding linked web sites) is controlled by 2112218 Ontario Inc. from its offices within the Province of Ontario, Canada. The Web Site can be accessed from all provinces and territories of Canada, as well as from other countries around the world. As each of these jurisdictions has laws that may differ from those of the Province of Ontario, by accessing the Web Site, the user agrees that all matters relating to access to, or use of, the Web Site, or any other hyperlinked web site, shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The user also agrees and hereby submits to the exclusive personal jurisdiction and venue of the courts of the Province of Ontario and acknowledges that the user does so voluntarily and is responsible for complying with local laws.
